1. Acceptance of Terms

By accessing and using the Recarted platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Recarted is a content monetization platform that connects social media creators with e-commerce through intelligent product detection, affiliate link management, and AI-powered tools. Our service enables creators to:

  • Create shoppable carts from their video content
  • Monetize their content through affiliate partnerships
  • Access AI-powered product detection and image editing tools
  • Track performance through comprehensive analytics

3. User Accounts and Roles

3.1 Account Types

We offer three types of user accounts:

  • Shoppers: Free accounts for browsing and shopping curated products
  • Creators: Accounts for content creators to manage and monetize their content
  • Administrators: System management accounts with full platform access

3.2 Account Requirements

To create a creator account, you must:

  • Have at least 1,000 followers on any supported platform
  • Regularly create product-focused content
  • Maintain an active presence on YouTube, Instagram, or TikTok
  • Provide accurate and complete registration information

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Creator Responsibilities

4.1 Content Guidelines

As a creator on our platform, you agree to:

  • Only feature products you genuinely use or recommend
  • Comply with FTC disclosure requirements for sponsored content
  • Ensure all content is original and does not infringe on third-party rights
  • Maintain professional standards in all content and interactions

4.2 Monetization

Revenue sharing and commission structures are defined in separate creator agreements. All affiliate relationships must comply with applicable laws and platform policies.

5. Intellectual Property

5.1 Platform Content

The Recarted platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Recarted and is protected by copyright and other intellectual property laws.

5.2 User Content

You retain ownership of content you submit to our platform. By submitting content, you grant Recarted a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content for the purpose of providing our services.

5.3 AI-Generated Content

Content generated using our AI tools becomes your property, subject to our platform's terms and any applicable third-party licensing requirements.

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Prohibited Uses

You may not use our service to:

  • Violate any applicable local, state, national, or international law
  • Transmit or procure the sending of advertising or promotional material without our prior written consent
  • Impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service
  • Use our AI tools to generate inappropriate, harmful, or illegal content

8. Third-Party Services

Our platform integrates with third-party services including YouTube, Instagram, TikTok, and various e-commerce platforms. Your use of these integrations is subject to their respective terms of service.

9. Payment and Billing

9.1 Creator Payments

Creator payments are processed according to individual creator agreements. Payment schedules, minimums, and methods are defined in those agreements.

9.2 Service Fees

We reserve the right to charge fees for premium services. Any fees will be clearly disclosed before you incur them.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will cease immediately. Any provisions of the Terms which by their nature should survive termination shall survive.

11. Disclaimers and Limitation of Liability

11.1 Service Availability

The service is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the use or results of this service.

11.2 Limitation of Liability

In no event shall Recarted be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Recarted operates, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
